Recruiters do not need your full immigration history. They ask "What is your visa status?" to answer three quick concerns: Can you start on time? Can you work without interruption for at least 12 months? Will you need the company to sponsor something unexpected?
When you are on OPT-STEM with a pending H-1B lottery, you have a strong, legal status. The problem is how you phrase it. If you lead with "I'm waiting on H-1B" without explaining your current work authorization, the recruer may assume you cannot start until October — or worse, that you are out of status right now.
The fix: lead with what is definite (your current OPT-STEM), then add the pending lottery as context.
"I currently hold OPT-STEM work authorization valid through [end date]. My employer has submitted an H-1B registration for this year's lottery, and I am awaiting the selection result. If selected, I will transfer to H-1B status on October 1st. If not selected, I can continue working on OPT-STEM through [end date]."
This does three things: (1) confirms you can start immediately, (2) shows you understand the process, and (3) removes uncertainty because you have a backup plan.
Generic articles tell you to "be honest" but never show you the exact rewrite. Here is a real before/after for the work authorization line you can place in your resume header or cover letter.
Before (vague, risky):
"Visa status: H-1B pending. Sponsorship required."
After (clear, recruiter-friendly):
"Work Authorization: OPT-STEM (valid through May 2026). Employer-filed H-1B petition pending for FY 2026 lottery. No gap in work authorization. Sponsorship may be transferred upon approval."
This rewrite explicitly states you are authorized to work today, names the program, and defines the time limit. It also avoids the word "need" — you are not asking for charity; you have a plan.
ATS systems often parse the header or top 10 lines of a resume first. If you place your work authorization in a two-column layout (e.g., "Visa: OPT" on the left, "Expiry: May 2026" on the right), the parser may read only the left column and miss the date. The result: your resume looks like you did not include an expiration date.
Fix: Write your full work authorization in a single line or bullet point, left-aligned, with no tab or column split. Example:
"Work Authorization: OPT-STEM through May 2026 | H-1B petition pending"
This one-line format is guaranteed to be read correctly by any ATS that parses the header area.
Answer: "I will continue working on OPT-STEM through its remaining validity. I am eligible for one more H-1B lottery attempt next year. My current employer is aware and supports this timeline."
Answer: "Yes, because I am already on OPT-STEM. I can start immediately. The H-1B change of status would take effect on October 1st with no interruption."
Answer: "No, my current employer filed a cap-subject petition. If I move to a cap-exempt employer (e.g., a university or nonprofit), I can file at any time." (Only say this if true.)
You have a 60-day grace period after OPT ends. If your H-1B is approved but start date is after your OPT expires, you can stay in the US during the gap as long as your petition is pending. Mention this only if asked.
Only if the job application requires it. For US companies, many applications ask "Will you now or in the future require sponsorship?" — answer "Yes" if you will need H-1B transfer after OPT ends, but clarify in the interview that you are currently authorized.
No. Lying on a US work authorization form (I-9 or E-Verify) is a federal offense. Even implying you do not need future sponsorship when you do can get your offer rescinded after background check.
Use the same script above but shorter: "I have OPT-STEM through [date], and my current employer filed an H-1B for me this year. I can start immediately." Keep it to 10 seconds.
